Brazilian Gaming Legislation Update

On 24 April, the Brazilian Senate's Constitution, Justice and Citizenship Commission revisited Bill 2234/22, which proposes legalising casinos, bingo, and jogo do bicho within specific settings. This long-standing bill could significantly enhance tourist complexes if passed without amendments. Concurrently, the National Congress scrutinised President Lula's vetoes on Law 14,790, which regulates online betting. Among these was a veto on a tax exemption for smaller betting wins, a measure some believe could push bettors towards unregulated markets.

Meanwhile, the Brazilian Sports Betting Association (ABAESP) initiated a petition to overturn the presidential veto that removed tax exemptions for small winnings in online betting, stressing that this could undermine efforts to channel betting through legal frameworks. 

Brazil Tightens Payment Regulations for Betting

The Brazilian Ministry of Finance has introduced payment guidelines for sports betting and online gaming via Ordinance No. 615. Enforced by the Secretariat of Prizes and Bets, these rules mandate that all transactions be processed through entities authorised by the Central Bank of Brazil, banning the use of cash, credit cards, cheques, and cryptocurrencies. 

Operators must maintain a R$5 million financial reserve for timely prize payouts. The ordinance prohibits operators from using bettors' funds for operational expenses and offers no bonuses for betting activities. Operators must complete payments to winners within two hours to reduce fraudulent practices.

Lottery Operations Spark Developments in Brazil

The National Federation of Caixa Staff Associations (Fenae) and the National Confederation of Financial Workers (Contraf-CUT) have filed a civil action to annul Caixa Econômica Federal's board decision to transfer lottery operations to its subsidiary, Caixa Loterias. Caixa's board asserts the transfer will enhance operational focus and efficiency amidst increasing competition from online betting platforms. Meanwhile, Caixa confirmed the return of its Exclusive Instant Lottery (Lotex) after an eight-year absence.

Local and state governments are exploring their lottery initiatives. Rio Branco's city council is deliberating on establishing a municipal lottery to boost city revenues. Additionally, the state of Maranhão launched Lotema, anticipating it will significantly contribute to public funds and generate jobs through local and sports betting operations. 

South Africa Moves to Regulate Online Gambling

The Democratic Alliance in South Africa has introduced the Remote Gambling Bill to regulate online gambling, shifting oversight to provincial authorities. This bill addresses a long-standing regulatory gap since the unenacted National Gambling Amendment Act 2008. It proposes comprehensive measures, including licencing, advertising standards, and responsible gambling provisions like mandatory spending limits for players and dispute resolution services. 

The news comes as South Africa approaches general elections on 29 May, potentially changing the political landscape and increasing the bill’s chances of passing. The bill is a step to protect consumers and reclaim revenues lost to unregulated online platforms.

The venue layout is designed to facilitate easy navigation across different gaming verticals and improve the visitor experience.
